Terms and Conditions

for Commissioned Illustration & Design Services
 

1. Scope

These Terms and Conditions apply to all commissioned work between Xenia Gesthüsen (hereinafter referred to as the "Artist") and her clients.
 

2. Services

The Artist provides creative services in the fields of illustration, graphic design, and visual communication.

The specific scope of services shall be defined in the respective quotation or individual agreement.
 

3. Quotations and Contract Formation

All quotations are non-binding and subject to change. A contract is concluded upon written confirmation of the order via email or upon commencement of the agreed services.
 

4. Fees

The fees agreed upon in the quotation shall apply. Unless otherwise stated, all prices are exclusive of applicable VAT.
 

5. Payment Terms

Invoices are payable within 14 days without deduction.

For larger projects, the Artist reserves the right to request advance payments or deposits.
 

6. Usage Rights

Usage rights to the commissioned work are granted only to the extent expressly agreed upon.

Any use beyond the agreed scope requires the prior written consent of the Artist.

Copyright and all related intellectual property rights remain with the Artist unless otherwise agreed in writing.
 

7. Revisions

The number of revisions included is defined in the respective project agreement.

Additional revisions or extensions to the agreed scope of work may be charged separately.
 

8. Liability

The Artist shall only be liable for damages resulting from intentional misconduct or gross negligence.
 

9. Final Provisions

The laws of the Federal Republic of Germany shall apply.

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

2. Scope

These Terms and Conditions apply to all orders placed through the online shop of Xenia Gesthüsen.
 

3. Products

The online shop offers original artworks.

As all artworks are handmade, slight variations in colour, texture, or appearance may occur.
 

4. Contract Formation

The presentation of products in the online shop does not constitute a legally binding offer.

By completing the ordering process, the customer submits a binding offer to purchase the products contained in the shopping cart.

The contract is concluded only upon dispatch confirmation or shipment of the goods.
 

5. Prices and Shipping Costs

All stated prices include applicable VAT where required by law.

Shipping costs are displayed separately during the checkout process.
 

6. Payment Methods

Payment may be made via:

  • PayPal

  • Bank transfer
     

7. Delivery

Shipping is available within Germany.

International shipping is available upon request.

Unless otherwise stated, orders are generally dispatched within 3–8 business days after receipt of payment.
 

8. Retention of Title

The goods remain the property of the Artist until full payment has been received.
 

9. Warranty

The statutory warranty rights under applicable law shall apply.
 

10. Right of Withdrawal

Consumers are generally entitled to a statutory right of withdrawal.

The right of withdrawal does not apply to custom-made or personalised products.
 

11. Liability

The Artist's liability is limited to cases of intentional misconduct and gross negligence.
 

12. Final Provisions

The laws of the Federal Republic of Germany shall apply.

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
